Architectural Violations

Thank you to the members of the Covenant Compliance Committee! This committee has been so helpful in assisting me with identifying boats, utility trailers, and campers being stored in violation of the Lake Forest restrictive covenants. As of March 6, 2008, a total of 90 property owners with storage violations have been advised that boats, utility trailers, and campers can only be stored on their property when stored inside their garage or behind a 6’ privacy fence. The majority of these owners have taken the necessary steps to comply with this covenant, and the owners that have not complied have been turned over to the Lake Forest attorney.
In addition to identifying storage violations, the Covenant Compliance Committee has identified properties, which over the past 4 months, have been found to consistently have cars or trucks parked in their front yard. These property owners will be sent letters advising them that their cars or trucks must be parked in their garage/carport, their driveway, or if parking is not available in the driveway, they may park in the yard’s 10-foot easement parallel to the street.
In June, we will begin identifying property owners whose home and/or yard are in an unclean, disorderly, unsightly, or untidy condition. We will be focusing on houses that are excessively dirty or mildewed; have pieces of trim or siding missing, broken windows, disorderly and cluttered carports, and yards that are not maintained and have weeds taller than 2 feet.

Member Charges for Architectural Violations to Begin April 1, 2008
The Architectural Committee has been authorized on behalf of the Association to levy a charge to any member who has been notified by the Architectural Department that their property is in violation of any declaration, rule, or regulation of the Lake Forest Property Owners Association, and after thirty (30) days continues to be in violation.
The charges will be as follows:
If a member fails to fully correct a violation for thirty (30) days after the date of notice, a charge of one hundred dollars ($100.00) will be levied against the member.
If a member further fails to fully correct a violation for sixty (60) days after the date of notice, a charge of an additional one hundred fifty dollars ($150.00) will be levied against the member.
If a member further fails to fully correct a violation for ninety (90) days after the date of notice, a charge of an additional two hundred dollars ($200.00) will be levied against the member.
For each subsequent month that a member further fails to fully correct a violation following the ninety (90) days after the date of notice, an additional two hundred dollar ($200.00) charge will be levied each month until the member fully corrects the violation.
Please note the following:
• All violation notices will be mailed to the member’s address currently on file with the accounting department. It is the responsibility of the member to update their mailing address.
• The violation notice will explain what the violation is and what the member needs to do to correct the violation.
• All members will be given thirty (30) days to correct their violation before being charged for non-compliance. If a member needs more than thirty (30) days to correct the violation, they can submit a written request to the Architectural Committee explaining why more time is needed. These requests will be approved on a case-by-case basis.

Effective September 10, 2007, the process for informing homeowners of violations will change. Homeowners will be given 30 days to correct the violation. Unless corrected within this time period or additional time requested within 15 days the violation will be turned over to the attorney for resolution. Requests for additional time must be clearly substantiated and found satisfactory by the Architectural Committee. Owners will be held liable for attorney and court costs. The City of Daphne will also be notified of any known infraction of city codes in the initial letter for their review and action. Serious consideration is also being given to exercising the right to abate unsatisfactory conditions at the expense of the owner. These changes are covered under Article XIV REMEDIES FOR VIOLATIONS as outlined in the associations By-Laws and Covenants. The September issue of the Lake Forester will address this subject in more detail.
